Income obtained (interest) on investments through Daslending(crowdlending)
For gains obtained on investments in crowdlending operations (interest) whose promoter is based in Portugal, Daskapital withholds the applicable tax (article 71 of the IRS Code). In the "Deducciones por doble imposición internacional, por razón de las rentas obtenidas y gravadas en el extranjero" box (box 588 of the Income Tax Return) you must enter the interests received and the total amounts withheld.
Investors should consult with the tax authorities, in order to verify the existence of double taxation treaties.
To declare gains for which tax has not been withheld, you must enter in the "Rendimientos por depósitos y activos financieros en general" box (box 027 of the Income Tax Return) the interest earned.
Income obtained from investments through Dasfactoring (crowdfactoring or invoice trading)
The profits obtained through Dasfactoring (crowdfactoring or invoice trading) have the tax treatment of capital gains in the IRPF, since they result from the difference between the net amount invested and the amount reimbursed. Unlike investment income, such as interest, there is no obligation to withhold tax on capital gains, so Daskapital does not withhold tax on income obtained through Dasfactoring in any case.
To declare capital gains in the annual income tax return, you must enter in the box "Otras ganancias patrimoniales a integrar en la base imponible del ahorro" (box 389 of the Income Tax Return) the income obtained in the operations of discount of promissory notes, purchase and sale of invoices, operations in the secondary market and bonuses received. Likewise, losses must be included when a loan is judicially declared to have failed.
